Terms of Membership

These Terms of Use ("Terms") govern your use of the website www.trypbug.com (the "Site") and any related services provided by Tryp Bug Inc. ("we," "us," or "our"). By accessing or using the Site, you ("Member," "you," or "your") agree to comply with these Terms. If you do not agree to these Terms, you must not use the Site.

MEMBERSHIP AGREEMENT

Membership Packages
Tryp Bug Inc. offers membership packages ("Membership") to eligible customers. By purchasing a Membership, you are entitled to access vacation packages ("Vacations") subject to the terms and conditions outlined in this Agreement.

Vacation Availability
Vacations offered through Tryp Bug Inc. are based on availability, and availability is subject to resort inventory. These Vacations are typically available when a resort has excess or unsold inventory, and as such, they are not guaranteed.

Vacation Duration
Your Membership is valid for two (2) years from the date of purchase ("Membership Term"). During this period, you may book Vacations subject to availability and the terms of this Agreement.

FULLFILMENT & TAXES

Fulfillment
Tryp Bug Inc. partners with Marketing Boost, a third-party service provider, for the fulfillment of all vacation bookings. Upon booking a Vacation, all arrangements will be made through Marketing Boost, and any changes, cancellations, or issues regarding the vacation will need to be handled directly with them. Tryp Bug is only the marketing company, Marketing Boost is the fulfillment company.

Taxes and Fees
While your Vacation is provided as part of your Membership package, you are responsible for paying all taxes, fees, and any other charges imposed by the resort or Marketing Boost at the time of booking. These charges are not covered by your Membership and must be paid directly to Marketing Boost or the applicable resort.

LIMITATIONS & EXCLUSIONS

No Guarantee of Vacation Availability
While Tryp Bug Inc. makes reasonable efforts to provide access to Vacations, we do not guarantee that you will be able to book any specific Vacation, nor that a particular resort will have availability during your preferred travel dates. Vacations are subject to availability, and no refunds will be given for failed bookings due to lack of availability.

Limitations of Liability
Tryp Bug Inc., its officers, employees, agents, or affiliates, are not liable for any loss, injury, or damages arising from your use of the Site or your Membership. This includes, but is not limited to, delays, cancellations, or other issues that arise in connection with your vacation booking through Marketing Boost or any third-party provider.

Force Majeure
Tryp Bug Inc. is not liable for any failure or delay in fulfilling its obligations under these Terms due to events outside of our reasonable control, including but not limited to natural disasters, strikes, pandemics, or other unforeseen circumstances.

USER RESPONSIBILITIES

Accurate Information
You are responsible for providing accurate and up-to-date information during the membership sign-up and vacation booking processes. Failure to do so may result in delays or the inability to book Vacations.

Compliance with Terms
You agree to comply with all applicable laws, regulations, and these Terms when using the Site and accessing your Membership benefits.

CANCELLATIONS & REFUNDS

Cancellation Policy
Tryp Bug Inc. does not offer refunds for Membership purchases. Vacations are subject to the policies of Marketing Boost and the respective resort, and you must adhere to their cancellation and change policies. If you cancel a vacation booking, you may be subject to cancellation fees as determined by Marketing Boost or the resort.

Refunds
Refunds for Membership packages are not available under any circumstances unless required by law.

WEBSITE CONTENT

All packages, destinations, hotels listed on TrypBug.com are displayed thru third party resources. They are examples of the savings you can receive thru your benefits package. Some may or may not be exactly accurate, but they are a pretty close representation of what to expect. We do our best to maintain accurate information, but sometimes may fall short. Tryp Bug Inc. and its suppliers, fulfillment agencies are not responsible for any inacurate information on TrypBug.com

DISPUTE RESOLUTION & GOVERNING LAW

Arbitration
Any disputes or claims arising out of or in connection with these Terms, your Membership, or the use of the Site, shall be resolved through binding arbitration. Arbitration shall take place in Orange County, FL, and the arbitration proceedings shall be conducted in English.

Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Jurisdiction
By using the Site, you consent to the exclusive jurisdiction of the courts located in [Location] for the resolution of any disputes not resolved through arbitration.

MODIFICATION TO TERMS

We reserve the right to modify these Terms at any time, with or without notice. Any changes to the Terms will be posted on this page with an updated effective date. Your continued use of the Site after such modifications constitutes your acceptance of the revised Terms.

TERMINATION OF MEMBERSHIP

Termination by Tryp Bug Inc.
Tryp Bug Inc. reserves the right to suspend or terminate your Membership at any time if we determine, at our sole discretion, that you have violated these Terms or engaged in any unlawful or inappropriate behavior.

Termination by You
You may cancel your Membership by contacting our customer support team. However, no refunds will be issued for any unused portion of your Membership.

PRIVACY & DATA COLLECTION

Privacy Policy
Your use of the Site is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Site, you consent to our Privacy Policy.

INDEMNIFICATION

You agree to indemnify and hold harmless Tryp Bug Inc., its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses (including legal fees) arising out of your use of the Site, your Membership, or any violation of these Terms.

MISCELLANEOUS

Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

Entire Agreement
These Terms constitute the entire agreement between you and Tryp Bug Inc. regarding your use of the Site and Membership and supersede any prior agreements or understandings, whether written or oral.
